Terms of Service.

1. Acceptance

ExamSOS (“the app”) is provided by CLS Industries SRL (“CLS”, “we”, “us”), Cluj-Napoca, Romania. By downloading, accessing, or using the app, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the app.

2. Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to use ExamSOS for your personal, non-commercial study on devices you own or control, in accordance with these terms and the App Store Terms of Service.

3. Subscriptions and billing

ExamSOS offers an auto-renewing subscription that unlocks its AI features:

• Monthly — US $9.99 / month (or the local equivalent).
• Yearly — US $49.99 / year (or the local equivalent), including a 3-day free trial for new subscribers.

How billing works

• Payment is charged to your Apple ID at confirmation of purchase.
• The subscription automatically renews at the same price unless you cancel at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours before the period ends.
• You can manage or cancel your subscription, and turn off auto-renewal, in your device’s Settings → Apple ID → Subscriptions.
• If you start a free trial, any unused portion is forfeited when you purchase a subscription.

Immediate access and your right of withdrawal

Subscribing gives you immediate access to AI-generated study content. Where a statutory cooling-off or right of withdrawal applies to digital content (for example, the 14-day right in the EU and the UK), by generating any AI content you expressly request that performance begins immediately and acknowledge that your right of withdrawal is extinguished for that billing period.

Refunds

Refund requests are handled solely by Apple, in accordance with Apple’s policies — we do not process payments and cannot issue refunds directly. ExamSOS may provide Apple with your in-app usage records to help assess a request; where AI features have been used during the billing period, we will generally contest the refund, consistent with the consent described above. This does not affect any mandatory consumer rights you have under applicable law.

4. Your content

You retain ownership of the documents, images, and notes you upload (“your content”). You grant CLS a limited licence to process your content solely to provide the service (including transmitting it to our AI sub-processors as described in the Privacy Policy). You are responsible for ensuring you have the right to upload your content, and you agree not to upload material that is illegal, infringes others’ rights, or is harmful.

5. Acceptable use

You agree not to:

• reverse-engineer, decompile, or attempt to extract source code or credentials from the app;
• circumvent usage limits, access the service through automated scripts, or interfere with its security;
• resell, redistribute, or commercially exploit the service or its output;
• use the app for anything unlawful or to generate harmful, deceptive, or infringing material.

6. AI-generated content — important disclaimer

ExamSOS uses artificial intelligence to generate study materials. AI output can be inaccurate, incomplete, or out of date — it can produce wrong answers, miss context, or state false information that appears correct (an effect often called “hallucination”). The materials are provided “as is” as a study aid only and are not professional, academic, medical, legal, or financial advice. You are responsible for independently checking and verifying any information before you rely on it. To the maximum extent permitted by law, CLS is not responsible or liable for the accuracy or completeness of AI-generated content, or for any answer, decision, grade, examination result, or other outcome arising from your reliance on it — you use AI-generated materials at your own risk. CLS does not guarantee any particular academic result.

7. Intellectual property

The app, its design, software, and branding are owned by CLS and protected by law. These terms grant you no rights in our intellectual property other than the limited licence to use the app.

8. Disclaimers and limitation of liability

The app is provided “as is” and “as available”, without warranties of any kind to the fullest extent permitted by law. To the maximum extent permitted by applicable law, CLS will not be liable for any indirect, incidental, or consequential damages, or for loss of data or profits, arising from your use of the app. Nothing in these terms limits liability that cannot be limited under applicable law, including your statutory consumer rights.

9. Termination

You may stop using the app at any time and delete your account from Settings → Delete Account. We may suspend or terminate access if you breach these terms or misuse the service. Provisions that by their nature should survive termination will survive.

10. Governing law

These terms are governed by the laws of Romania and the European Union, without prejudice to mandatory consumer-protection rights you have in your country of residence.

11. Apple App Store terms

The following apply because you obtained ExamSOS through the Apple App Store:

• This agreement is concluded between you and CLS only, not with Apple. Apple is not responsible for the app or its content.
• Apple has no obligation to furnish any maintenance or support for the app.
• In the event of any failure of the app to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• CLS, not Apple, is responsible for addressing any claims relating to the app, including product-liability, legal/regulatory, and consumer-protection claims, and any third-party claim that the app infringes intellectual-property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting”, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
